These Terms of Use & Medical Disclaimer (“Terms”) govern your access to and use of the services, platforms, content, consultations, medicines, telephonic support and other offerings provided by Apnovate Health Pvt Ltd doing business as Apna Homeopathy (“Apnovate”, “we”, “us”, or “Apna Homeopathy”). By using our website, ordering medicines, booking or attending a consultation, or otherwise using our services you agree to be bound by these Terms. If you do not agree, do not use our services.
Important: These Terms are written to protect Apnovate and the Apna Homeopathy brand, and to set clear expectations with patients and visitors. They are not a substitute for legal advice—please consult your lawyer to tailor these Terms to your business and local regulations.
1. Definitions
- Services — teleconsultations, medical advice, prescriptions, personalized medicines, subscription services, patient support, and any content available on our website or via phone/app.
- Patient / You / User — any individual who uses or attempts to use the Services.
- Healthcare Professional / Doctor — a registered homeopathic practitioner or other licensed healthcare provider engaged by Apnovate.
2. Scope of Services & Nature of Advice
- Apnovate provides teleconsultation and homeopathic treatment advice and arranges delivery of personalized homeopathic medicines created on the basis of the consultation.
- Consultations may be provided directly by registered homeopathic doctors or by trained clinical staff under doctor supervision; only registered doctors provide prescriptions and clinical treatment plans.
- Homeopathy is a complementary and supportive system of medicine. Our Services are meant for non-emergency management of conditions and general health support only and are not a substitute for in-person emergency care, surgery, intensive care, or specialist medical interventions.
3. Medical Disclaimer & No Guarantee of Results
- No warranty of cure. Apnovate and its doctors make reasonable efforts to advise and treat, but do not guarantee any particular outcome, cure, or improvement.
- Not responsible for patient outcomes. Apnovate is not liable for treatment failure, adverse reactions, progression of disease, complications, hospitalization, or death whether or not correlated in time with our Services.
- No emergency care. If you are experiencing a medical emergency, do not use our Services — seek immediate in-person emergency medical care or call emergency services.
4. Patient Representations & Responsibilities
By using our Services you agree to:
- Provide truthful, complete, and accurate medical history, medications, allergies, test reports.
- Inform the doctor of any change in condition, side-effects, or problems.
- Follow prescriptions and instructions exactly.
- Seek immediate in-person care when required.
- Not falsify identity, medical records, or payment details.
5. Consent to Telemedicine & Electronic Communication
- By booking a teleconsultation you consent to receive medical advice via electronic means and prescriptions as permitted by law.
- Teleconsultations have limitations (no physical exam, reliance on your information). You accept these.
- Consultations/calls may be recorded for quality, training, and legal recordkeeping.
6. Medicines, Dispensing, Delivery & Returns
- Medicines are personalized and non-returnable/refundable once dispatched, except where refund/replacement is explicitly agreed after verification.
- Apnovate is not liable for delays, losses, or damages by couriers or events beyond control. Verified lost/damaged medicines may be replaced/refunded at our discretion.
- Patients must inspect delivery at receipt, retain packaging, and report damage immediately.
- In case of adverse reaction, stop medicine, seek urgent care, and report to Apnovate.
7. Fees, Payment & Refund Policy
- Fees must be paid in advance unless agreed otherwise.
- Refunds only if: (a) order cannot be processed due to our error, (b) refund approved after verification, (c) required by law.
- No refunds once personalized medicines are dispatched (except where explicitly accepted).
8. Limited Liability (Core Protection)
- Liability cap: Maximum liability limited to the amount actually paid for the specific Service.
- Excluded damages: No liability for indirect, incidental, consequential, punitive damages, profit loss, data loss, goodwill loss, or emotional distress.
- Limitations apply regardless of legal theory.
9. Indemnity
You agree to indemnify Apnovate, Apna Homeopathy, and their employees, officers, directors, and affiliates from any claims, damages, or expenses arising from your misuse, breach, negligence, or false information.
10. Confidentiality, Records & Data Protection
- Patient data is handled per our Privacy Policy and law.
- Data is disclosed only as required by law, or for treatment, billing, or with consent.
11. Intellectual Property
All content (text, graphics, logos, trademarks, images, software) is owned by Apnovate. You cannot copy or exploit without written permission.
12. Third-Party Products & Links
We are not responsible for third-party websites, products, or services. Dealings are at your own risk.
13. Compliance with Law & Medical Standards
- Services subject to Indian laws and regulations (including telemedicine and pharmacy rules).
- Apnovate may refuse treatment or delivery if it contravenes law or standards.
14. Warranties & Disclaimers
- No implied warranties (merchantability, fitness, accuracy).
- No guarantee of uninterrupted access or error-free operation.
15. Force Majeure
We are not liable for delays/failures due to natural disasters, pandemics, strikes, government acts, or failures of third-party services.
16. Termination & Suspension
We may suspend/terminate access anytime for breach, fraud, legal requirement, or safety concerns.
17. Dispute Resolution & Governing Law
- Governed by Indian law.
- Jurisdiction: Courts of Jaipur, Rajasthan, India.
18. Severability, Waiver & Entire Agreement
- Invalid provisions will be severed; remainder remains valid.
- Failure to enforce rights is not waiver.
- Together with Privacy Policy, these Terms are the entire agreement.
19. Notices & Changes to Terms
- Terms may be updated; revised version with new Effective Date will be posted.
- Continued use = acceptance.

20. Additional Patient Safety & Notes
- Emergencies: Call emergency services or visit hospital.
- Allergies: Disclose allergies; stop medicine if reaction occurs.
- Pregnancy & Children: Extra precautions — disclose before treatment.

Feedback may be used royalty-free, perpetually, to improve Services.
